Arbitrators and Mediators serve as a Neutral in any professional matter in which they appear. As such, there is a constant concern about avoiding any appearance of a “lack” of neutrality or a “bias” in favor of an attorney or a party. We strive to avoid any action that might even appear to reflect a potential “conflict of interest”. As such, it is difficult for an Arbitrator or Mediator to request and receive a “Testimonial” from an attorney or party in the event of being invited to serve as an Arbitrator or Mediator at a subsequent hearing involving that attorney or party.
